Agreement to Terms
By accessing and using this website and our design services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.
Services Description
qualtrexbrixel provides logo design, branding packages, and business card design services. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your project requirements
- Respond to design revisions and feedback requests in a timely manner
- Make payments according to agreed terms and schedules
- Ensure you have rights to any content or materials you provide
Intellectual Property
Upon full payment, you will receive ownership rights to the final design files. We retain the right to use completed projects in our portfolio and for promotional purposes unless otherwise agreed in writing.
Payment Terms
Payment terms are specified in your project agreement. All prices are in New Zealand Dollars (NZD) and include GST unless otherwise stated. We reserve the right to withhold delivery of final files until payment is received in full. Payment methods accepted include bank transfer, credit card, and other methods as agreed.
Consumer Guarantees Act
Our services are provided in accordance with the Consumer Guarantees Act 1993. This means our services must be:
- Of acceptable quality and fit for purpose
- Match the description provided
- Delivered within a reasonable time
If our services do not meet these guarantees, you have rights under New Zealand consumer law, including the right to a remedy.
Revisions and Changes
Revision rounds are included as specified in your selected package. Additional revisions may incur extra charges, which will be discussed and agreed upon before work commences. Major changes to project scope may require a new agreement and additional fees. All scope changes must be agreed in writing.
Limitation of Liability
To the maximum extent permitted by New Zealand law, qualtrexbrixel liability is limited to the amount paid for the specific service. We are not liable for any indirect, incidental, special, or consequential damages. This limitation does not affect your rights under the Consumer Guarantees Act 1993 or other mandatory New Zealand consumer protection laws.
Dispute Resolution
If you have a complaint or dispute, please contact us first. We will work with you to resolve the matter. If we cannot resolve the dispute, you may contact:
- Commerce Commission for Fair Trading Act matters
- Disputes Tribunal for consumer disputes under $30,000
- Small Claims Court for other matters
Governing Law
These Terms of Use are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand. The Consumer Guarantees Act 1993, Fair Trading Act 1986, and Privacy Act 2020 apply to our services.
Changes to Terms
We may update these Terms of Use from time to time. Material changes will be notified to existing clients. Continued use of our services after changes constitutes acceptance of the updated terms.
